Terms of Service

1. Acceptance of Terms

By accessing or using the Bezal API, dashboard, documentation, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. Important: These Terms create a legally binding agreement between you ("Customer", "User", "You") and Bezal ("Company", "We", "Us", "Our"). If you do not agree to all provisions of these Terms, you may not access or use the Service. We may also modify these Terms from time to time. Continued use after changes constitutes acceptance.

2. Service Description & Multi-Courier Rates

Bezal provides a multi-courier API that enables you to integrate real-time shipping rate calculations into your e-commerce platform or checkout system. Our Service aggregates rates from multiple carrier partners (including but not limited to Posta, Nation, Jumia, G4S, Fargo, Ena Coach, Easy Coach, The Guardian.etc) and returns estimated shipping costs based on package weight, origin, and destination and compares them.

Rate Disclaimer: Shipping rates provided through our API are estimates based on carrier rate cards. Final charges may vary due to different reasons or other carrier-imposed adjustments. Bezal does not guarantee rate accuracy and is not responsible for discrepancies between estimated and actual carrier invoices.

3. User Obligations & Acceptable Use

As a user of our multi-courier API, you agree to the following obligations and restrictions:

Your Responsibilities:

1. Provide accurate and complete registration information
2. Maintain the confidentiality of your API keys and authentication credentials
3. Secure your checkout integration against unauthorized access or abuse
4. Transparently display shipping rates to your end customers without misleading information

Prohibited Uses:

Reselling raw API access — You may not sublicense, resell, or distribute our API as a standalone service
Web scraping or data mining — Automated extraction of rate data for competitive purposes
Misrepresenting rates — Altering, inflating, or fabricating courier rate information
Illegal shipments — Using our API to facilitate prohibited or restricted items

Violation of these terms may result in immediate suspension of your API access without notice.

4. Rate Display

Rate Display to Your Customers:

When displaying courier rates to your end users during checkout, you agree to:

1. Clearly identify the carrier name for each rate option (e.g., "Posta Kenya", "Nation Courier")
2. Show estimated delivery timelines provided by our API
3. Include a disclaimer that rates are estimates and subject to carrier adjustments
4. Maintain a link to this Terms page or your own shipping policy

6. Intellectual Property Rights

All technology, documentation, SDKs, and API specifications provided by Bezal are our exclusive intellectual property. You are granted a limited, non-exclusive, non-transferable license to use our API solely for integrating shipping rate display into your checkout process.

You may not reverse engineer, decompile, or attempt to extract source code from our API
You may not remove or obscure any copyright or trademark notices
All rights not expressly granted are reserved by Bezal

Any feedback, suggestions, or improvement ideas you provide about the Service become our property and may be used without compensation.

7. Limitation of Liability & Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEZAL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Inaccurate shipping rate estimates provided by carrier partners
Delays, interruptions, or errors in API response times
Unauthorized access to or use of your API keys
Any bugs, viruses, or other harmful code transmitted through the Service

Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Total Liability: In any case, Bezal's aggregate liability shall not exceed the total fees paid by you to Bezal during the six (6) months preceding the event giving rise to the claim.

8. Termination & Suspension

Either party may terminate this agreement at any time with 30 days written notice. Bezal reserves the right to suspend or terminate your access immediately if:

1. You violate any provision of these Terms
2. Your usage exceeds reasonable limits and you fail to upgrade your plan
3. Your use of the API poses a security risk or harms other users

Upon termination, you must immediately cease using all Bezal APIs and delete any cached rate data. Provisions that by their nature should survive termination (including liability limitations and intellectual property) will remain in effect.

9. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Nairobi, Kenya, in accordance with the rules of the Nairobi Centre for International Arbitration (NCIA).

Each party shall bear its own arbitration costs unless otherwise ordered by the arbitrator. You agree to waive any right to participate in class-action litigation against Bezal.
